Government publishes the Great Repeal Bill

Posted on 14 July 2017SharePrint

The Government has published the European Union (Withdrawal) Bill, informally known as the Great Repeal Bill, which will incorporate EU law into UK law and finalise the Brexit process. The bill will repeal the 1972 European Communities Act, which took Britain into the EU and will end the jurisdiction of the European Court of Justice (ECJ).

The intention of the bill is to ensure a smooth transition after Brexit and minimise disruption to businesses and individuals. It is also considered that continuing with EU rules and regulations will make trade negotiations with the EU easier, as the UK remains committed to those minimum standards.

There are more than 80,000 elements to the complete body of EU law, made up of regulations, statutory instruments or Acts that implement EU law and decisions made by the ECJ. This makes the transition process extremely complicated and to facilitate this the bill will give ministers the powers to amend certain laws without full parliamentary scrutiny – a very controversial proposal.

While negotiations on the final Brexit deal are still ongoing it remains unclear as to what the position of the UK will be regarding the single market and the customs union.
